A Great Disadvantage
My experience with the Cobb County Police (see my earlier post, I’m Suspected Of Being A Child Molester.) and then afterward, documenting the steps involved in covering for the officers actions, taught me a very important lesson, which I would like to share with my readers at great personal risk and peril.
Officers in Cobb County can lie and say almost anything without repercussion. This puts citizens at a great disadvantage on the streets, and in the courtrooms.
Why Do I Believe?
After my incident with Cobb police, I phoned an old high school friend who happened to be a veteran LAPD(Los Angeles Police Department) officer and a detective. After going over the Cobb officer’s incident reports, and my pointing out a few obvious officer discrepancies, my friend, who had been doing his very best to cover for the officers, reluctantly admitted that he would never have written a report in such a questionable and easily disprovable style (I’m paraphrasing).

Torn To Shreds! (Factual or Fantasy Synopsis?)
The reason being, the detective inferred, was that he would be torn to shreds on the witness stand. Exactly as I was thinking. Why then in Cobb County, Georgia, are officers not fearful of being torn to shreds on the witness stand after writing untrue, often ridicoulous statements in their incident reports(or factual synopsis’)?
A New One?
I planned on ripping the officer’s a ‘new one,’ once I got them on the stand. Did Georgia pass legislation which enables law enforcement to embellish facts with the narrative eye of a Hollywood action film director, and not be questioned on the stand about their credibility? The Ross Harris trial may answer this question?

Case In Point.

In the case of Mr. Devin Howell, On August 25th, 2017, Cobb officers wrote that the deceased, “suddenly woke up,”…spoke in a, “demonic voice,” …and called them,”white devils.” It gets better… Mr. Howell then“became aggressive”, and “attacked the officers,” while, “flying through the air like superman”.Mr. Howell later announcing to the officers, for some odd reason, that he had a gun, when he did not(see my previous post, Excited Delirium Syndrome, & Precinct 4: part 1).
The AJC Protects The CCPD(again)
By August, 2018, a Cobb Grand Jury cleared the officers involved, and the Atlanta Journal Constitution’s Zachary Hansen covered for the Cobb County Police. Hansen wrote ,Officers found Howell unresponsive and not restrained by a seat belt, but he was soon revived and began to advance on the officers, Isaza said. At that point, one of the officers fired his Taser at Howell.
Howell continued to struggle, leading officers to handcuff him to a long backboard until an ambulance arrived, Isaza confirmed. He then fell back into cardiac arrest and died.Howell had an extensive medical history, Isaza confirmed, but the manner of death was labeled as “complications of excited delirium syndrome.”
Nothing at all mentioned about ‘demonic voices’, ‘guns’, or ‘flying like superman!’ Thanks for nothing, Zach, and the Atlanta Journal Communist.

A Phantom Gun Shot
Cobb police initially claimed that Vince fired a gun at officers. Another officer wrote that Vince ‘brandished a gun’. A gun was found on the scene but at no point was the gun brandished and certainly no gun was fired by Vincent. According to Atlanta’s 11 Alive, GBI Director Vic Reynolds, who met with the family in October, told them Truitt “never pointed a gun at any officer. The officer never commanded Truitt to drop his weapon, stop, or not to move.”
Vincent Truitt was shot twice in back on July,13th,2020 after a 2 second chase and then asked the officer,” Why did you shoot me?” Vincent Truitt wouldn’t be the first Cobb citizen to ask this question.Nor the last, unfortunately.
On February 18, 2021. A Cobb Grand Jury clears Cobb County Police Officer of Vincent Truitt’s death .

Truitt family attorney, Gerald Griggs said that the family was treated with more respect by former District Attorney Joyette Holmes, and by GBI Director Vic Reynolds, than by current DA Flynn Broady.

A Pretty Big Damn Lie
The suspect fired a weapon at officers? That’s a pretty damn big lie(see my post… Meet The New Boss… Cobb County’s Historic, First, Black, District Attorney, Flynn Broady Jr.: This Funky, Soul, Brotha’ Promises Love, Equality, And Diversity (along with mass incarceration, for more details)And I thought my officers told a tall tale.
The Law:
O.C.G.A 16-3-20
On February 18, 2021, the District Attorney presented evidence to the Cobb County Grand Jury regarding the use of force involving the Cobb County Police Department Officer Max H. Karneol which occurred on July 13. 2020, in Cobb County, Georgia. After reviewing the evidence presented, which included the testimony of Georgia Bureau of Investigation Agent Taylor, body worn camera footage and dash mounted camera footage, the 2021 JANUARY FEBRUARY Term Grand Jury, by majority vote, has determined the use of force by the officer involved was authorized pursuant to O.C.G.A. 16-3-20, and 17-4-20.
6-3-20. Justification
The fact that a person’s conduct is justified is a defense to prosecution for any crime based on that conduct. The defense of justification can be claimed:
(1) When the person’s conduct is justified under Code Section 16-3-21, 16-3-23, 16-3-24, 16-3-25, or 16-3-26;
(2) When the person’s conduct is in reasonable fulfillment of his duties as a government officer or employee;
(3) When the person’s conduct is the reasonable discipline of a minor by his parent or a person in loco parentis;
(4) When the person’s conduct is reasonable and is performed in the course of making a lawful arrest;
(5) When the person’s conduct is justified for any other reason under the laws of this state; or
(6) In all other instances which stand upon the same footing of reason and justice as those enumerated in this article.
17-4-20
(b) Sheriffs and peace officers who are appointed or employed in conformity with Chapter 8 of Title 35 may use deadly force to apprehend a suspected felon only when the officer reasonably believes that the suspect possesses a deadly weapon or any object, device, or instrument which, when used offensively against a person, is likely to or actually does result in serious bodily injury; when the officer reasonably believes that the suspect poses an immediate threat of physical violence to the officer or others; or when there is probable cause to believe that the suspect has committed a crime involving the infliction or threatened infliction of serious physical harm. Nothing in this Code section shall be construed so as to restrict such sheriffs or peace officers from the use of such reasonable nondeadly force as may be necessary to apprehend and arrest a suspected felon or misdemeanant.
(c) Nothing in this Code section shall be construed so as to restrict the use of deadly force by employees of state and county correctional institutions, jails, and other places of lawful confinement or by peace officers of any agency in the State of Georgia when reasonably necessary to prevent escapes or apprehend escapees from such institutions.
Back to my original question, How Are The Cobb County Police Enabled To Lie, Conspire, And Fabricate Evidence?
Any laws on the books about law enforcement lying in their incident reports?
